HBO notes a forum post by "Major Nelson" (Larry Hyrb), Director of Programming for Xbox Live, that offers an interesting look at what happens to the paid content for Live services if your Xbox console suddenly dies:


Q:My box broke, and I need to get a new one. I went to (insert favorite retailer here) and got a new box...how can I get the maps I already purchased onto the new box.
A: You will need to purchase the content again. Premium content is tied to the Xbox it was downloaded on NOT the gamertag.
Another backpedal operation by Microsoft, it seems - people with knowledge of how Downloadable Content functions have always been well aware that downloads are "keyed" to specific Xbox units, through serial number and/or EEPROM values.

Interestingly enough, back when Xbox Live was being demonstrated to beta testers and fansite personnel, one of the questions asked was with respect to recovery of downloadable content - Microsoft personnel assured gamers that content purchases would be stored with their gamertag, so that if their console was out of commission they could recover paid content. Guess this didn't work out from a sales/marketing perspective... so if your Xbox is on its last figurative legs, the best option will be to purchase the Expansion Pack DVD to ensure you can transfer the content to a newer unit.
